  • Open Air Dining Permit Application

  • Before submitting a request for an Open Air Dining Permit, please review the following: 

    1. Beverly Hills Municipal Code (BHMC) 10-3-3501.
    2. Parklet Guidelines
    3. Open Air Dining Guidelines (Ministerial / Staff-Level Architectural Reveiw)

    Application timelines and fees may vary depending on the type of configuration submitted.

      Confirm Each Statement by Checking Box
    • 1. PARKLET: 

      1. Parklet is not installed on a street where the speed limit is over 25mph.
    • 2. UMBRELLAS:

      1. Proposed umbrellas meet the required minimum clearance for the height of the lowest element.  The minimum clearance above private property is 7 feet, and the minimum clearance on the public right-of-way is 8 feet.  
      2. No signage is placed on umbrellas.
    • 3. RAILINGS

      1. Railings are removeable. 
      2. Maximum height for railings are 42 inches. 
      3. Railings are designed for a horizontal lateral load of 50 lbs. per foot when load is applied to the top of the rail. 
      4. Railings post and sleeve are attached or installed to the sidewalk.
      5. Construction of railings includes flush plugs to cover the holes of the sleeves when barrier is removed. 
    • 4. RAILING & UMBRELLA COMBINATION

      1. Umbrellas are affixed to the railing.
    • 5. ACCESSIBILTY:

      Open air dining areas must meet accessibility requirements specified in Chapter 11B of the California Building Code in effect at the time of the application submittal, including but not limited to: 

      1. Knee & toe clearance. 
      2. Clear floor or ground space for wheelchair location.
      3. Clear Ingress & egress path of travel.
      4. Floor & ground surfaces shall be stable, firm, and slip resistant.  Surface slope shall be 2%.

    • 1. AN APPLICATION IS CONSIDERED INCOMPLETE WITHOUT THE FOLLOWING SUBMITTAL DOCUMENTS: 

      • A DIAGRAM PLOTTING SPECIFIC LOCATIONS OF EQUIPMENT, TENTS, CANOPIES, BARRICADES, HEDGEROWS, EXITS, ETC.
      • PROOF OF INSURANCE.
    • 2. APPLICANT IS REQUIRED TO COMPLY WITH FEDERAL, STATE OF CALIFORNIA, OR LOS ANGELES COUNTY REGULATIONS, ORDERS, OR PROTOCOLS RELATING TO WORKPLACE SAFETY OR PUBLIC'S HEALTH AND SAFETY WHEN PROVIDING SERVICES IN THE CITY OF BEVERLY HILLS.  

      APPLICANT IS SOLEY RESPONSIBLE FOR ENSURING THAT ALL PERSONNEL ONSITE AT ESTABLISHMENT(S) FOLLOW SAID HEALTH AND SAFETY PROTOCOLS. 

    • 3. A PERMIT IS NOT ISSUED UNTIL ALL RELATED CITY PERMITS ARE RECIEVED.  

      I HEARBY CERTIFY THAT THE ABOVE INFORMATION IS TRUE AND CORRECT TO THE BEST OF MY KNOWLEDGE AND ANY EDITS MUST BE MADE IN WRITING.  

      I CERTIFY THAT I AM AWARE OF AND AGREE TO COMPLY WITH THE RULES AND REGULATIONS AS PROVIDED FOR IN TITLE 4 OF THE BEVERLY HILLS MUNICIPAL CODE, AND RESTRICTIONS LISTED BY DEPARTMENTS IN THE IN THE MUNICIPAL CODE, PERTAINING TO ISSUE OF A PERMIT.

      I ACKNOWLEDGE THAT LACK OF TIMELINESS AND OR MATERIAL CHANGES TO THE EVENT MAY RESULT IN PERMIT DENAILA OR ASSESSMENT OF FINES OR FEES.
